"User" or "you" refers to any individual or entity using or accessing the Arbiter application, including all authorized representatives acting on behalf of an entity.
"High Table Member" refers to lawyers who join the Bono platform. Each High Table Member is required to undergo a Know Your Customer ("KYC") verification process. During the Early Access Phase, KYC is conducted manually, with plans to transition to a partner-supported automated KYC process in the future.
"Early Access Phase" indicates that the application is in a preliminary stage of release, where users are informed of potential software bugs and limitations in functionality.
"Personal Data" means any information relating to an identified or identifiable natural person, as defined under applicable data protection laws.
"Services" encompasses all functionalities, features, and offerings available through the Arbiter application.
These definitions are intended to clarify the terminology used within these Terms and are not exhaustive. Additional terms may be defined within the context of these Terms as necessary.
3. User Responsibilities and Obligations
As a user of the Arbiter application, you are required to adhere to the following detailed responsibilities and obligations:
Eligibility Criteria: You represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into and comply with these Terms. If you are accessing the application on behalf of an entity, you further represent and warrant that you have the authority to bind such entity to these Terms.
Account Security and Confidentiality: You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to accept responsibility for all activities that occur under your account. You must promptly notify Bono Network Corp of any unauthorized use of your account or any other security breach, and you must take all reasonable steps to mitigate any such breach.
Legal Compliance: You shall comply with all applicable laws, statutes, ordinances, and regulations regarding your use of the application, including but not limited to, intellectual property laws, privacy and data protection laws, and export control laws. You acknowledge that it is your responsibility to understand and comply with these laws and regulations.
Content Standards and Intellectual Property: You agree that any content you submit, upload, or otherwise make available through the application will not infringe upon the intellectual property rights or other proprietary rights of any third party. You warrant that you have the necessary rights, licenses, and permissions to use and share such content.
Data Protection and Privacy: Users are strongly advised to pseudoanonymize data to enhance privacy and security, particularly during the Early Access Phase. You agree to handle all Personal Data in compliance with applicable data protection laws, and you acknowledge that you are responsible for any data you process using the application.
Prohibited Conduct: You agree not to engage in any activities that could potentially harm or disrupt the application or its users, including but not limited to:
- Attempting to gain unauthorized access to the application, other user accounts, or computer systems or networks connected to the application.
- Introducing viruses, trojans, worms, or other harmful material.
- Engaging in any form of automated data collection, including but not limited to, scraping, data mining, data extraction, or data harvesting.
These responsibilities and obligations are critical in maintaining a secure and compliant environment for all users of the Arbiter application. Non-compliance may result in suspension or termination of your access to the application, at the sole discretion of Bono Network Corp.
4. Special Conditions and Industry-Specific Provisions
The following provisions are applicable to your use of the Arbiter application:
Early Access Acknowledgment: Users understand and acknowledge that the Arbiter application is currently in its Early Access Phase. This phase means the application is still undergoing development and enhancement, and may thus exhibit software bugs or other technical issues. Users are advised to exercise due diligence and to pseudoanonymize sensitive data to protect privacy and security.
Know Your Customer ("KYC") Requirements for High Table Members: All individuals seeking to become High Table Members, defined as legal professionals joining the Bono platform, are required to undergo a KYC verification process. During this Early Access Phase, the verification is conducted manually. Bono Network Corp anticipates transitioning to an automated KYC process facilitated by a trusted third-party partner in the foreseeable future.
Adherence to B2B2C SAAS and AI Application Standards: The Arbiter application, as a B2B2C Software as a Service (SAAS) and AI-driven platform, is designed to comply with industry benchmarks and regulatory standards specific to these technologies. Users can expect the following commitments to quality and compliance:
- Regulatory Compliance: The application is developed in alignment with applicable regulations governing software as a service and artificial intelligence technologies, such as data protection laws, consumer protection statutes, and industry-specific guidelines.
- Best Practices in Software Development: Arbiter employs state-of-the-art software development practices, including secure coding protocols, rigorous testing procedures, and continuous integration and deployment methodologies. This ensures a reliable and secure user experience.
- Data Management and Security: The platform incorporates advanced data management techniques, including encryption, access controls, and regular security audits. These measures are designed to protect user data from unauthorized access and breaches.

Users acknowledge the existing risks associated with utilizing a platform that is still in the developmental stage.
These provisions are crafted to establish transparent expectations and responsibilities for users while ensuring alignment with industry practices and regulatory requirements.
5. Dispute Resolution and Governing Law
This section outlines the mechanisms for resolving disputes and the legal framework governing these Terms:
Governing Law: These Terms and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the United States, specifically the laws of the State of Delaware, without regard to its conflict of law principles.
Informal Resolution: Before initiating any formal dispute resolution proceedings, the parties are encouraged to first attempt to resolve the dispute informally by contacting Bono Network Corp at info@bono.network. The parties agree to negotiate in good faith to resolve any dispute within 30 days of notice of the dispute.
Arbitration: If the dispute cannot be resolved informally, it shall be resolved by binding arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) in the English language. The arbitration will take place in Delaware, and the arbitrator's decision shall be final and binding. Each party shall bear its own costs in the arbitration, except as may be otherwise provided in the AAA rules.
Class Action Waiver: Users agree to resolve disputes with Bono Network Corp on an individual basis, and waive any right to participate in a class action lawsuit or class-wide arbitration.
Injunctive Relief: Notwithstanding the foregoing, Bono Network Corp reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or mitigate any actual or threatened breach of these Terms.

- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the application by any third party;
- Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the application.
Disclaimer of Warranties: The Arbiter application is provided on an "as-is" and "as-available" basis. Bono Network Corp expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Bono Network Corp does not warrant that:
- The application will meet your specific requirements;
- The application will be uninterrupted, timely, secure, or error-free;
- The results that may be obtained from the use of the application will be accurate or reliable;
- The quality of any products, services, information, or other material purchased or obtained by you through the application will meet your expectations;
- Any errors in the application will be corrected.
Early Access Disclaimer: Users acknowledge the application is in an Early Access Phase and may contain bugs and defects. Bono Network Corp does not guarantee the completeness or accuracy of the application during this phase. Users are encouraged to report any issues encountered to help improve the application.

Waiver: No waiver by Bono Network Corp of any breach or default of these Terms shall be deemed to be a waiver of any preceding or subsequent breach or default. Any waiver must be in writing to be effective.
Assignment: Bono Network Corp may assign or delegate its rights and obligations under these Terms, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under these Terms without Bono Network Corp's prior written consent, and any unauthorized assignment and delegation by you is void.
Relationship of the Parties: These Terms do not and shall not be construed to create any partnership, joint venture, employer-employee, agency, or franchisor-franchisee relationship between you and Bono Network Corp.
Force Majeure: Bono Network Corp shall not be responsible or liable for any failure to perform or delay in performance of any obligation under these Terms that is caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
